We hear this one almost every day. I got caught in a speed trap, don’t drive on such and such streets… they’ve set up a speed trap. Do they exist? Of course they do. Are they legal? Afraid not. This is where knowledge of the law comes in handy and why sometimes it pays off to hire a good attorney to make sure not only that your ticket goes away but that the corresponding point does not show up on your record.

California vehicle code 40801 prohibits speed traps and 40802 defines what a speed trap is. Most of us would probably not know anything regarding surveys of certain sections of the road and what principles are used in determining the whole speed trap concept. And therefore citations are issued using radar, laser or aircraft on the relevant sections of the road which may constitute a speed trap and may also help you beat that ticket.

Research is important but most of us either don’t have the time or have no idea where to start… hence the lawyer. If you can do traffic school and have no points presently on your license then it’s a no brainer, pay the ticket and go to traffic school. If that criteria does not apply to you… meaning that you already have points or are not eligible for traffic school then think of the ramifications such as your insurance climbing out or control.
